Parental Relocation

When one parent wishes to relocate, whether with or without the child, it creates an issue concerning parenting time and potentially custody. This can be one of the most challenging issues faced in family law, primarily due to the risk of loss or damage to the relationship between the child and the parent who will be living at a distance.

When it comes to relocation cases, the courts approach with caution, prioritizing the best interest of the child above all else. Contrary to what one might assume, the focus isn't solely on what's best for the parent wishing to relocate or the one facing separation from the child. While these factors are considered, the main concern is the child's well-being.

While the court cannot outright prevent a parent from relocating, it does possess the authority to intervene if the move is deemed contrary to the child's best interest. This intervention might take the form of preventing a parent from moving with the child. In cases where a parent attempts to relocate without the other's consent, the non-moving parent has legal recourse. They may obtain a restraining order, effectively halting the move and ensuring the child's stability.
