Five Myths About Divorce and Dissolution

Myth #1: Divorces are always hostile.


FACT: While the divorce process can undoubtedly be emotional, it does not have to be hostile or hate-driven. Many spouses separate amicably and go on to lead great relationships as friends and co-parents. Whether your divorce will be amicable or hostile depends on the relationship you have with your spouse and your reasons for wanting to separate.


Myth #2: Dissolutions are easier than divorces.


FACT: The main difference between a divorce and dissolution is that the spouses involved must come to an agreement on all terms before dissolution paperwork can be filed. This does not automatically mean that dissolutions are an easier process than divorce—dissolutions can have as much conflict, if not more than a divorce! Whether a dissolution will be “easy” depends on what terms, if any, the spouses have not yet agreed upon.


Myth #3: Adultery can severely harm the outcome of the cheating partner’s divorce.

         

FACT: Adultery alone does not serve as a factor in child custody and division of property. In the state of Ohio, adultery is grounds for issuing a divorce, just like incompatibility and extreme cruelty. However, there would need to be additional facts to significantly impact the outcome of your divorce.


Myth #4: Only women are awarded child and/or spousal support.


FACT: The law governing awards of child and spousal support are gender neutral. Child and spousal support are awarded on the basis of multiple factors, including the incomes of the parties and the parenting time schedule.


Myth #5: Divorce harms children.


FACT: Every child is unique and will process their parents’ separation in their own way. More importantly, how the parents react and navigate the divorce process has a greater impact on the child(ren)’s reaction.
